Terms of Service

Last updated 28 September 2026

These Terms of Service (“Terms”) are a binding agreement between you and PAASNEXT (“PAASNEXT”, “we”, “us”) covering your use of PAASNEXT at paasnext.com, including deploying and hosting applications, running a SaaS business on the platform, and every related website, API and service (the “Service”).

Our Privacy Policy, Acceptable Use Policy and, where you process other people’s personal data on the Service, our Data Processing Addendum form part of these Terms. By creating an account, ticking the box to accept these Terms, or using the Service, you agree to them. If you accept on behalf of a company or other organisation, you confirm you are authorised to bind it, and “you” means that organisation.

Section 21 sets out additional rights for consumers in the United Kingdom. Nothing in these Terms limits any right you have by law that cannot be limited by contract.

1. Eligibility and your account

  • You must be at least 18 years old and able to enter into a binding contract. The Service is designed for business and professional use.
  • Give accurate information when you sign up and keep it up to date, including your billing details.
  • You are responsible for all activity under your account, including by team members you invite, and for keeping your password and two-step verification codes secure. Each login is for one person only.
  • Tell us promptly at support@paasnext.com if you suspect unauthorised access to your account.

2. The Service

PAASNEXT builds, deploys and hosts the applications you provide, supplies domains and TLS certificates, and lets SaaS owners sell their own product to their own customers. The features, resource limits and price of each plan are shown on our pricing page and at checkout before you buy.

We continually improve the Service and may change, add or remove features. If a change materially reduces the core functionality of a paid plan during a period you have already paid for, we will give you reasonable advance notice by email and, if you prefer, you may cancel and receive a pro-rata refund of the unused part of that period. Features we label beta or preview are provided as-is and may change or end at any time.

3. Prices, payment and taxes

  • Paid plans are billed in advance in US dollars, monthly or yearly, through our payment processors Stripe or PayPal. Your bank may charge its own currency-conversion or foreign-transaction fees.
  • Prices exclude VAT, sales tax and similar taxes. Where we are required to charge tax, we add it at checkout at the applicable rate. You are responsible for any other taxes due on your purchase.
  • You authorise us and our payment processors to charge your chosen payment method for all fees when they fall due, including every automatic renewal described in section 4.
  • The Free plan is a trial for testing that a deployment works. It is not for production or commercial use, needs no payment method, and is limited to one per person and email address. It ends after its stated number of days or when its build minutes run out, whichever comes first, and your applications are then stopped. If you do not move to a paid plan within the stated number of days after that (3 days unless the plan says otherwise), your account and everything in it — projects, applications, deployments and their data — is permanently deleted. We email you before this happens.
  • Other platform plans do not include free trials unless a specific offer says otherwise.

4. Automatic renewal and cancellation

YOUR SUBSCRIPTION RENEWS AUTOMATICALLY. At the end of each monthly or yearly billing period it renews for another period of the same length, and we charge the price then in effect for your plan to your payment method on file, until you cancel.

We email you before every renewal and, for yearly plans, also about 30 days before the renewal date. We will give you at least 30 days’ notice by email before any price increase applies to you, and you may cancel before it takes effect.

You can cancel online at any time from Billing in your account — no phone call or email is needed. Cancellation takes effect at the end of the billing period you have already paid for; you keep full access until then and are not charged again. You may also delete your account at any time, which ends the subscription immediately (see section 15).

5. Changing plans

  • Upgrades paid by card take effect immediately, and you are charged a prorated amount for the rest of the current billing period.
  • Downgrades, and any plan change paid through PayPal, take effect at the start of your next billing period. A downgrade is refused if your current usage would exceed the new plan’s limits.

6. Refunds

Except as set out in section 2, section 21 or where the law requires otherwise, fees you have paid are non-refundable, including for partial billing periods, downgrades and unused capacity. We may issue a refund or account credit at our discretion; doing so once does not oblige us to do it again.

7. Late and failed payments

If a payment fails, your applications keep running while we retry and we email you straight away. If the balance is still unpaid 1 day after it was due, your applications are stopped (not deleted) and we remind you by email each day. If it remains unpaid 10 days after it was due, your deployments and their data may be permanently deleted.

Paying the outstanding balance at any point before deletion restores your applications. We may change these timings by giving you notice by email; they will never be shorter than stated when a payment first became overdue.

8. Plan limits and fair use

Each plan includes limits such as the number of applications, memory, CPU and storage. If you exceed a limit we will warn you by email, and if you are still over it 7 days later, the applications beyond your limit may be stopped (not deleted) until you upgrade or reduce your usage. Your use of shared resources must also follow the Acceptable Use Policy.

9. Your content and data

  • You keep all rights in the code, content and data you upload, deploy or store (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, build, run, transmit, back up and display Your Content only as needed to provide, secure and support the Service.
  • You are responsible for Your Content and confirm you have all rights needed to use it on the Service and that it does not break the law or these Terms.
  • Keep your own backups. Files an application writes to its local disk are temporary and are removed each time it is redeployed, and deleted data cannot be recovered.
  • Environment variables and credentials you store are encrypted at rest. We access Your Content only to provide the Service, to give support you ask for, to keep the platform secure, or where the law requires.

10. Running a SaaS on the platform

  • If you sell your product through the Service, you are the seller and the merchant of record to your customers. Their payments go directly to your own Stripe or PayPal account, under your agreement with that provider; we do not take a share of them.
  • You are solely responsible for your own terms of service, privacy notice, pricing, taxes, refunds, consumer-law obligations and customer support, and for all activity of your customers on the instances you provide them.
  • For your customers’ personal data you are the controller (or business) and we are your processor (or service provider). Our Data Processing Addendum applies to that data and forms part of these Terms.

11. AI features

Some optional features use a third-party AI model to explain build errors or propose fixes. When you choose to use them, the relevant build logs and code are sent to that provider solely to produce the result; they are not used to train its models under our agreement with it. AI output may be inaccurate — review it before relying on it.

12. Acceptable use and security

You must use the Service in line with our Acceptable Use Policy. If you find a security vulnerability in the Service, please report it to support@paasnext.com and give us a reasonable time to fix it before disclosing it; do not access data that is not yours or degrade the Service while testing.

13. Availability and support

We work to keep the Service fast, secure and available, and publish its live status on our status page. We may carry out maintenance, which we try to schedule at quiet times and announce in advance where it is likely to cause noticeable disruption. Unless we agree a service-level commitment with you in writing, we do not guarantee any particular level of uptime. Support is available at support@paasnext.com.

14. Third-party services

The Service works with third-party services such as GitHub, Stripe and PayPal. Your use of them is governed by their own terms, and we are not responsible for their availability or conduct. A list of the providers that process personal data for us is in our Data Processing Addendum.

15. Suspension and termination

  • You may stop using the Service at any time, and you may delete your account from your settings. Deleting your account immediately and permanently removes your applications, deployments and account data and ends your subscription; export anything you need first.
  • We may suspend or terminate your access, in whole or in part, if you materially breach these Terms or the Acceptable Use Policy, fail to pay, put the Service, other customers or third parties at risk, or where we are required to by law. Where it is safe and lawful we will tell you first and give you a reasonable chance to fix the problem.
  • We may end the Service for all customers on at least 90 days’ notice, in which case we will refund any fees prepaid for the period after it ends.
  • Section 3 (for fees already due), section 9 and sections 16 to 24 survive termination.

16. Intellectual property and feedback

PAASNEXT, its software, design and brand belong to PAASNEXT and our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing; they do not transfer any ownership. If you send us feedback or suggestions, we may use them freely without any obligation to you.

17. Export controls and sanctions

You must comply with all export-control and sanctions laws that apply to you and to the Service, including those of the United States and the United Kingdom. You confirm that you are not located in, or ordinarily resident in, a country subject to comprehensive US or UK sanctions, and that you are not named on any US or UK government list of restricted persons.

18. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, AND WE DISCLAIM ALL WARRANTIES AND CONDITIONS NOT EXPRESSLY STATED IN THESE TERMS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF DATA LOSS. THIS SECTION DOES NOT AFFECT ANY STATUTORY RIGHTS OF CONSUMERS THAT CANNOT BE EXCLUDED.

19. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) NEITHER PARTY IS LIABLE TO THE OTHER FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL OR ANTICIPATED SAVINGS, OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND US$100.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, FOR YOUR PAYMENT OBLIGATIONS, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW.

20. Indemnity

If you use the Service for business purposes, you will defend and indemnify us against third-party claims, and related losses and reasonable costs, arising from Your Content, your use of the Service in breach of these Terms or the law, or, if you run a SaaS on the Service, your dealings with your own customers. We will tell you promptly about any such claim and let you control its defence, provided you do not settle it in a way that admits fault on our behalf without our consent.

21. Additional rights for UK consumers

  • If you are a consumer in the United Kingdom — using the Service mainly outside your trade, business, craft or profession — you have legal rights under the Consumer Rights Act 2015 that these Terms do not affect, including the right to services performed with reasonable care and skill and to digital content that is of satisfactory quality and as described.
  • You have the right to cancel your first purchase within 14 days of the day you buy it, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Because the Service starts immediately at your request, if you cancel in that period we will refund what you paid less a proportionate amount for the Service provided up to the time you tell us you are cancelling. To cancel, email us a clear statement of your decision at support@paasnext.com or cancel from Billing. We will refund you within 14 days, to the original payment method.
  • Nothing in sections 18 to 20 limits our liability to you for breach of your statutory rights. If you are a UK consumer, section 20 (indemnity) does not apply to you.

22. Changes to these Terms

We may update these Terms, for example to reflect changes to the Service or the law. We will email you at least 30 days before a material change takes effect, and show the updated date at the top of this page. If you do not agree with a change you may cancel before it takes effect; otherwise, continuing to use the Service after that date means you accept the updated Terms. Changes do not apply to disputes that arose before they took effect.

23. Governing law and disputes

  • Before starting any formal proceedings, please contact us at support@paasnext.com so we can try to resolve the matter informally; both parties agree to negotiate in good faith for at least 30 days.
  • If you are located in the United States, these Terms are governed by the laws of the US state in which PAASNEXT is incorporated and the federal laws of the United States, and any dispute will be decided exclusively by the state and federal courts of the US state in which PAASNEXT is incorporated, and each party consents to their personal jurisdiction. To the extent permitted by law, business customers may bring claims only on an individual basis and not as a plaintiff or class member in any class or representative action.
  • If you are located in the United Kingdom or anywhere else, these Terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and you keep the protection of the mandatory laws of the place you live.

24. General

  • Notices: we send notices to the email address on your account; you can send notices to us at support@paasnext.com. You agree that notices, agreements and other communications we provide electronically satisfy any legal requirement that they be in writing.
  • These Terms, with the documents they refer to, are the entire agreement between you and us about the Service and replace any earlier agreement on the subject. You may not transfer your rights under them without our written consent; we may transfer ours to a successor of our business on notice to you.
  • If any part of these Terms is found unenforceable, the rest remains in effect. Not enforcing a right straight away does not waive it. Neither party is liable for delay or failure caused by events beyond its reasonable control.
  • Nobody other than you and us has any right to enforce these Terms, including under the Contracts (Rights of Third Parties) Act 1999.
